General background

The EU Anti-Corruption Initiative in Ukraine (EUACI) is the European Union’s technical support program in the area of anti-corruption in Ukraine, co-funded and implemented by the Ministry of Foreign Affairs in Denmark. The overall objective of the EUACI is to achieve significant progress in preventing and countering corruption, ensuring the coherence and systemic anti-corruption activities of state and local self-government bodies, and to empower civil society and citizens to contribute to the combatting of corruption, as well as the proper process of Ukraine’s post-war recovery. The program runs till April 2027.

The Parliamentary Committee on Anti-Corruption Policy (CAP) is one of the program partners. The Committee performs legislative, organizational and oversight functions. CAP mandate covers anti-corruption policy development; corruption prevention and counteraction; conflict of interest; asset declarations; ethics in public sector; liability for corruption and related offenses, regulations and organization of work of NACP, NABU, SAPO, ARMA; activities of other state agencies in the area of anti-corruption; protection of persons facilitating fight against corruption. The Committee processes draft laws relevant for anti-corruption policy, conducts corruption proofing of draft laws submitted to the Parliament, oversees the policy implementation.

Given the role of the Committee in the fight against corruption, EUACI is providing support to CAP, including by hiring a National Anti-corruption Adviser (Service Provider) who will assist with the policy and legal analysis and advise on anti-corruption to the Committee.

Objective

Overall objective of this activity is to support the work of CAP by providing timely, objective and competent policy and legal analysis and advise, which will contribute to the enhanced effectiveness of anti-corruption framework and improved track record of corruption cases.

Particularly, the Service Provider would contribute to work on draft legislation and amendments in the area of anti-corruption, assist with corruption proofing of draft laws and with the analysis of various aspects of policy implementation, including functioning of various state institutions involved in the fight against corruption.

Scope of work

The Service Provider will be working closely with the CAP management and EUACI for the fulfillment of the following tasks:

  • Preparing legal and policy analysis on draft laws, policy documents, other documents affecting anti-corruption policy, on request and upon the guidance of the CAP management.
  • Contribute to the development of draft laws, amendments to them, supplementary documents on request and upon the guidance of the CAP management.
  • Preparing information notes (such as statistics, reviews and updates on legislative and other developments over the specific period of time, case-law on specific aspects), on request and upon the guidance of the CAP management.
  • Conducting analysis on the selected aspects of anti-corruption policy implementation, functioning of the institutions within the competence of CAP, identified policy and legal issues affecting fight against corruption, preparing results of such analysis on request and upon the guidance of the CAP management.
  • Other related activities, as requested by CAP management upon EUACI approval.

The Service Provider will receive tasks and the guidance from the CAP management, although it is expected that the Service Provider will report on the implementation of tasks to EUACI.

The Service Provider cannot represent the CAP and must work as a professional independent of party-political interests.

Deliverables

The Service Provider will provide the following deliverables within the scope of the work:

  • Notes, analytical papers, briefs and other documents with the legal and policy analysis relevant for anti-corruption and related aspects (as described above).
  • Draft laws, supplementary documents to them (such as explanatory notes, comparative tables etc.), amendments to the draft laws.
  • Participation in the meetings with CAP management, EUACI and, upon request and guidance of CAP management, with other stakeholders.
  • Monthly reports outlining main activities performed in the reporting period (max 2 pages).
  • Detailed final report providing main achievements and challenges, as well as possible recommendations for follow-up activities (max 5 pages).
  • Other deliverables, as requested by CAP management upon EUACI approval.

Qualifications

The Service Provider shall meet the following criteria:

  • Bachelor’s or Master’s degree in law, public administration, social science or other discipline relevant for this assignment.
  • At least 5 years of proven previous experience in anti-corruption, rule of law reforms, criminal justice or other related field.
  • Proven previous experience in conducting analysis and preparing various analytical products (such as papers, notes, reports, studies etc.).
  • Proven track record of such documents relevant for anti-corruption is an advantage.
  • Previous experience in drafting laws, legal acts, amendments and/or supplementary documents is an advantage.
  • Excellent analytical and communication skills.
  • Fluency in Ukrainian, working knowledge of English is preferrable.
  • Commitment of confidentiality and conflict of interest resolution.

Budget, timeframe, and location

The total budget for this assignment is EUR 32,500.

The intended commencement date is the date of signature of the contract with the consultant, and the period of implementation of the contract will be 12 months, with a duration of up to 260 working days.

Payments will be made on a monthly basis and in accordance with the agreed working days, the delivered products and after assessing the quality thereof. 

The contract does not presume covering travel, accommodation, or per diems.

Reporting and management

The performance of the Contractor will be judged upon reaching the purpose of this contract as well as obtaining its results, as indicated in the section “Objective” and “Deliverables” herein respectively. Moreover, the performance of the Contractor will be judged upon the successful implementation of all the specific activities indicated in Section “Scope of work” of this document

By signing the contract, the Consultant agrees to hold in trust and confidence any information or documents (“confidential information”) disclosed to the Consultant or discovered by the Consultant or prepared by the Consultant in the course of or as a result of the implementation of the contract, and agrees that it shall be used only for the contract implementation and shall not be disclosed to any third party. The Consultant also agrees not to retain copies of any written information or prototypes in its archive and for its use.

The Service Provider shall refer to the CAP management.

  • Financial offer, including daily fee and the number of working days.
